Terms & Conditions_Sell
Source Designer reserves the right to change these terms and conditions from time to time. The current version of the Consignment Terms and Conditions are those accessible on the website.
1. Exclusive Agreement
Upon agreement by the Consignor/Seller (you) of the resale price of your Product, the consignment agreement takes effect. This must be an exclusive appointment with Source Designer. The Product cannot be self-marketed or listed with any alternative website. If the Product is found to be listed elsewhere, the Consignor will be charged the full commission by Source Designer before the item will be returned to the Consignor to cover photography and marketing costs.
2. Delivery of Product to Source
The Consignor/Seller shall be solely responsible for the cost of delivering the Products to Source, unless otherwise specified as part of an agreement in writing. All risk of loss or damage to the Products while those Products are in transit to Source, remains with the Consignor.
3. Condition and Authenticity
The Consignor/Seller warrants that Product delivered to Source is not a copy, counterfeit “fake” or replica.
For handbags, Source requires evidence in the form of the original receipt, authenticity card and matching serial number inside the bag (where applicable). If this cannot be provided, we will authenticate your product for you. A charge of $40 will apply; deducted from your sale proceeds.
The Product must be delivered to Source Designer as authenticate, having been cleaned, repaired and exactly as represented in the photographs submitted on the ‘Sell My Items’ form. If products are deemed unsatisfactory after inspection by Source and according to our determination, not genuine (after our verification checks) or not as represented by the Consignor/Seller in the provided photos, the product consignment can be refused. In this event, the product will be returned to the Consignor/Seller and the cost of $150 for authentication and return shipping will be at the expense of the Consignor/Seller. If you require a Verification Certificate, this can be requested for a cost of $40.
If the Product is authentic but deemed not clean, additional cleaning or repairs may be required and the Seller will be charged that amount up front before the Product is listed on the website.
3a. Products Able to be Sold
Source reserves the right to refuse items that do not align with our brand, or are not to our high standard; for example with significant damage, heavy wear or missing parts.
We stock luxury brands such as Chanel, Louis Vuitton, Hermès, Gucci, Prada, Dior, Fendi, Celine, Balenciaga and other premium designer labels at our discretion. Plus Australian iconic brands including Aje, Alemais, Carla Zampatti, Christopher Esber, Henne, Manning Cartell, Rachel Gilbert, Scanlan Theodore and Zimmermann.
Categories include women’s handbags and occasion wear (cocktail, races, formal and wedding wardrobe or guests), eyewear, footwear, scarves and belts.
4. Consignment / Sale Period
The consignment shall begin the date the Products are received by Source Designer and ends when the Product is sold, or the consignor opts to have the Product(s) returned; provided that 2 weeks’ notice is given and that the Product has not just sold.
The Consignor/Seller agrees that Source Designer will have the item for a minimum 90-day sale period. After such time, all terms and conditions remain on a rolling agreement basis. The consignor can request to have the item returned before the expiration of the 90-day sale period but agrees to pay a $300 charge for marketing and return shipping expenses.
5. Return of the Product or Not Sold
In the event the Product has not sold after the 90-day sale period, the consignor can request the return of the Product and only needs to pay the cost of the return postal shipping.
Source Designer may require the removal of the Products from sale, with reasonable notice to the Consignor (e.g. no longer selling). The cost of collecting or return shipping of the Products will be borne by the Consignor/Seller. If the Consignor does not remove the designated Products within (1) one month of written notice, the Products shall be deemed abandoned by the Consignor and full title will pass to Source with no further conditions. Source will then donate abandoned Products in its sole discretion.
Return of the Product to the Consignor/Seller must be arranged via an appointment if collecting locally (to enable time for items to be packed), or via pre-arranged return shipping.
6. Title to Product
The Consignor warrants to Source Designer that you legally own and are authorised to sell the Product. Title to and ownership of the Products will always remain with the Consignor.
7. Effort to Market and Price Discounts
Source will make every effort to sell the Product at the agreed original price. This may include using the product in photo shoots and in promotional or social media. However, not all items consigned to us will feature in marketing, depending on current market trends.
In the event of a website-wide offer, the Consignor/Seller agrees to split the potion of the discount with Source; that amount to be deducted from the Seller’s profits.
Due to our ‘Tuesday Drop’ format, it may take 2-3 weeks before Seller’s items are featured, if there is high demand and longer processing times.
If the Product remains unsold, price reductions can be agreed with the Consignor.
8. Payment and Source’s Fees
Upon sale of the Product, the Consignor will receive payment from Source, after any authentication fees, cleaning/repair fees and our commission fees below have been retained from the final sale price.
25% for items $1 - $999
20% for items $1,000 - $3,999
15% for items $4,000 - $8,999
10% for items over $9,000
Payment will be made within 10 business days to the Consignor’s nominated bank account.
Additional fees may include verification of authenticity ($40 as standard or $150 for Hermes) if the Consignor is unable to provide original receipts, plus any cleaning, bag restoration and repairs (to be determined and approved up front). If an item does not sell, the Consignor/Seller agrees to pay the shipping cost to have the Product returned to them.
Any amounts which the Consignor/Seller owes to Source Designer, which are not recovered through the sale of the Product, will be paid by the Seller prior to collection of the Product.
8a. Source LayBy Deposits
Items over AUD1,000 can be purchased on a LayBy basis, if a deposit has been paid. Buyers have 6 weeks to pay in full, during which time the item will be removed from the website for sale. In the event a buyer cannot fulfill on their contract by the end of 6 weeks, they will forfeit their deposit. A consignor/seller does not have claim to that deposit.
During a LayBy period, the item will be held by Source Designer until the final payment has cleared into our bank account. Then funds will be issued to the consignor/seller.
9. Item Processing
Each item is processed upon arrival to us, including verification, photography and uploading to the website which also acts as a record of the condition the item was received. Handbags are given an Entrupy digital “footprint” for tracking purposes.
During periods of high demand, it may take 2-3 weeks before your item is marketed.
10. Risk of Loss or Damages
All risk of loss of the Products will pass to Source once the Products are in our possession. If the Products are lost or stolen while in Source’s possession, a Product Sale will be deemed to have occurred, and Source will reimburse the Consignor in the amount of the Products’ re-sale price under this agreement which reflects the current Market Value Replacement Price. Alternatively, a replacement product can be sourced and provided at the agreement of both parties.
11. Electronic Signatures
This Agreement may be executed in one or more counterparts, each of which shall be deemed an original but all of which shall constitute one and the same instrument. For purposes of this Agreement, use of e-mail and online forms, or other electronic medium shall have the same force and effect as an original signature.
By completing the online form and/or agreeing a sale price for your Product, you authorise Source Designer to sell your items in accordance with any specific instructions you give, otherwise subject to Source Designer’s discretion.
12. Privacy Policy and Use of Data
When you sell with Source or sign up for our newsletter, we may contact you via email to keep you updated about your purchase, plus additional promotional offers and new arrivals.
